Welcome to Cellar Pro, developed by Shankar Dutt. By downloading, installing, or using our application, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.
1. Acceptance of Terms
By accessing or using Cellar Pro, you agree to these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the application.
2. Description of Service
Cellar Pro is a mobile application designed to help users manage their wine and spirits collections. The app provides features for tracking bottles, recording tasting notes, monitoring drinking windows, scanning wine labels, barcode scanning, price lookup via external services (Vivino, Wine-Searcher, Wine.com, CellarTracker), food pairing suggestions, Siri Shortcuts integration, and more.
3. Age Requirement
You must be at least 17 years of age to use Cellar Pro. By using the app, you represent and warrant that you meet this age requirement. The app is intended for personal use in managing alcoholic beverage collections and does not promote underage drinking.
4. Introductory Trials, Subscriptions, and Lifetime Purchase
Cellar Pro is a paid product. Monthly and Yearly subscriptions include a 7-day introductory trial for eligible Apple IDs. Lifetime access is available as a one-time purchase and does not include a trial.
- Monthly Subscription: $4.99/month, billed monthly after any eligible introductory trial
- Yearly Subscription: $29.99/year, billed annually after any eligible introductory trial
- Lifetime Purchase: $49.99 one-time payment for permanent access, with no trial
Payment is processed through Apple's App Store. Trials and purchases begin through the Apple purchase flow. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage and cancel subscriptions in your App Store account settings.
5. Refunds and Cancellations
All purchases are processed through the Apple App Store. Refund requests must be made directly through Apple:
- To request a refund: Visit reportaproblem.apple.com and sign in with your Apple ID
- Refund eligibility: Refunds are granted at Apple's discretion according to their refund policies
- Cancellation: You can cancel your subscription at any time through your device's Settings > [Your Name] > Subscriptions
If you cancel a subscription, you will continue to have access until the end of your current billing period. No partial refunds are provided for unused portions of a subscription period.
6. User Accounts
Cellar Pro does not require account creation. Your data is stored locally on your device and optionally synced via your personal iCloud account. You are responsible for maintaining the security of your device and iCloud account.
7. Acceptable Use
You agree to use Cellar Pro only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the app for any illegal purpose
- Attempt to reverse engineer, decompile, or disassemble the app
- Remove or alter any proprietary notices
- Use the app to transmit malware or harmful code
- Interfere with the proper functioning of the app
8. Intellectual Property
Cellar Pro and its contents, features, and functionality are owned by Shankar Dutt and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without written permission.
9. User Content
You retain ownership of any content you create in Cellar Pro, including tasting notes, photos, and collection data. By using the app, you grant us a limited license to process and store your content solely for the purpose of providing the service to you.
10. Disclaimer of Warranties
Cellar Pro is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that:
- The app will be error-free or uninterrupted
- Defects will be corrected
- The app is free of viruses or harmful components
- Information about wines, drinking windows, or food pairings is accurate
- Label scanning will correctly identify all wines
11. Limitation of Liability
To the maximum extent permitted by law, Shankar Dutt shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Cellar Pro. Our total liability shall not exceed the amount you paid for Cellar Pro in the past 12 months.
12. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses arising from your use of Cellar Pro or violation of these Terms.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of significant changes through the app or by updating this page. Your continued use of Cellar Pro after changes constitutes acceptance of the new Terms.
14. Termination
We may terminate or suspend your access to Cellar Pro at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or us.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
