1. Agreement and Apple’s Standard EULA
Cellar Pro is licensed, not sold, to you. Your licence to use it is governed by Apple’s Licensed Application End User License Agreement (the “Standard EULA”). These Terms of Use add to the Standard EULA. If the two conflict, the Standard EULA prevails. Purchases are also subject to the Apple Media Services Terms and Conditions.
By downloading, purchasing or using Cellar Pro, you agree to these terms.
2. Who you are agreeing with
These terms are between you and Shankar Dutt, trading as DuttLabs (“we”, “us”), and not with Apple Inc. We, not Apple, are solely responsible for Cellar Pro and its content.
3. Age
Cellar Pro is about collecting alcoholic drinks. You must be of legal drinking age in your country or region, and at least 18 years old, to use it. The app is for lawful personal collection management and does not encourage excessive or underage drinking. Please enjoy responsibly.
4. The app
Cellar Pro helps you manage a wine and spirits collection. Its features include bottle records, label scanning and barcode lookup, storage locations and a cellar map, drinking windows and reminders, tasting notes, value tracking and insights, backups, imports and exports, widgets, an Apple Watch companion app and optional iCloud sync. Features may change as the app is updated.
5. Plans, subscriptions and free trial
Cellar Pro is a paid app with no free tier. Every option below unlocks the same features:
- Monthly Access: $4.99 per month, auto-renewing, with a 7-day introductory free trial for eligible Apple IDs.
- Yearly Access: $29.99 per year, auto-renewing, with a 7-day introductory free trial for eligible Apple IDs.
- Lifetime Access: $49.99 one-time purchase that unlocks the app permanently, with no trial.
Prices are shown in US dollars. The App Store sets local prices, which may vary by region and include applicable taxes. Payment is charged to your Apple ID when you confirm a purchase, or when a free trial ends. A subscription renews automatically at the then-current price unless you cancel it at least 24 hours before the end of the current period, and your account is charged for renewal within the 24 hours before the period ends. If you cancel during a free trial, you are not charged. Introductory offers are available once per Apple ID, as determined by Apple. Purchases are not available through Family Sharing.
6. Cancellation, restore and refunds
Manage or cancel subscriptions in your Apple account settings (Settings, then your name, then Subscriptions) or from Manage Subscription in the app. Access continues until the end of the period you paid for. Use Restore Purchases in the app to restore a subscription or Lifetime purchase on any iPhone or iPad signed in to the same Apple ID. Apple handles all refunds under its own policies at reportaproblem.apple.com.
7. Your content
You own the records, notes, photos and other content you create in Cellar Pro. It is stored on your devices and, if you choose, in your iCloud account, as described in the Privacy Policy. You are responsible for keeping backups. The app provides JSON backup and CSV export for this purpose.
8. Acceptable use
Use Cellar Pro only for lawful purposes. Do not reverse engineer, decompile or modify the app except as the law allows, interfere with its operation, remove proprietary notices, or use it to break any law, including laws on the sale or purchase of alcohol.
9. Third-party services
Some features use services we do not control: Apple services for purchases, iCloud sync and notifications, Open Food Facts for barcode lookup, and external websites opened by price lookup links. Those services have their own terms and privacy policies, and we are not responsible for their content or availability.
10. Information only
Values, drinking windows, label recognition, barcode results, food pairings, vintage and region information, and external price searches are a guide only. They may be incomplete or wrong. They are not financial, insurance or valuation advice. Check important details yourself before you buy, sell, insure, store or drink a bottle.
11. Maintenance and support
We provide support for Cellar Pro through the support page and by email. Apple has no obligation to provide any maintenance or support services for the app.
12. Warranty
To the extent the law allows, Cellar Pro is provided “as is” and “as available”, without warranties beyond those that cannot be excluded. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for the app. Any other claims, losses, liabilities, damages, costs or expenses caused by a failure to conform to a warranty are our responsibility, to the extent the law requires.
If you are a consumer in Australia, you have guarantees under the Australian Consumer Law that cannot be excluded. Nothing in these terms limits rights you have under the consumer laws where you live.
13. Product claims
We, not Apple, are responsible for addressing any claims by you or a third party relating to the app or your possession or use of it, including product liability claims, claims that the app fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
14. Intellectual property
Cellar Pro, including its design, code, name, icon and content we provide, belongs to Shankar Dutt or his licensors. If a third party claims that the app or your possession and use of it infringes their intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling and discharging that claim.
15. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill, arising from your use of Cellar Pro. Our total liability for any claim is limited to the amount you paid for Cellar Pro in the 12 months before the claim. These limits do not apply where the law does not allow them.
16. Legal compliance
You confirm that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
17. Apple as third-party beneficiary
Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple has the right, and is deemed to have accepted the right, to enforce these terms against you as a third-party beneficiary.
18. Governing law
These terms are governed by the laws of the Australian Capital Territory, Australia, without regard to conflict-of-law rules. The courts of the Australian Capital Territory have non-exclusive jurisdiction. If you are a consumer, you keep the protection of the mandatory laws of the country where you live, and you may bring a claim in your local courts.
19. Changes to these terms
We may update these terms as the app changes. We will post the new version here with a new effective date. If you keep using Cellar Pro after an update takes effect, you accept the revised terms. Changes do not affect purchases you have already made.
